Congress has the authority to regulate commerce among the states, and can sometimes “preempt” state action regarding interstate commerce.

But it is wrong and ahistorical to say that congressional *inaction* still means states are barred from exercising core police powers.

This is also called VC originalism where we invent ways of twisting “Founder’s intent” to aggregate power for the maximum benefit of tech companies and the maximum risk for people and voters. This will be politically disastrous.
